Inter-country Child Abduction: An Explorative Analysis of Legal Standards and Judicial Construal's in India

The paper gives an explorative analysis of judicial and legal landscapes of inter-country child abduction by parents in India. The Inter-country child abduction cases typically involve couples in failed matrimonial relationships, where one parent unilaterally takes the child back to his or her native country. The paper through the leading judicial cases dwells into the principles propounded by Indian Judiciary in inter-country child abduction cases. It examines the latest Indian legislative initiative to tackle inter-country child abduction, the draft Civil Aspects of Inter-Country Parental Abduction Bill, 2016. This paper analyses whether the Bill is in conformity with Hague Inter-Country Civil Abduction Convention and a strong mechanism to tackle inter-country child abduction.
